The act of visiting our website for the purposes of viewing, gathering information, or purchasing our products constitutes an agreement in which the user understands, agrees and is bound to the Terms and Conditions set forth below.  FAH Performance encourages you to read the Terms in full before moving forward. If you do not agree with the Terms set forth, then please discontinue to use our website. These Terms apply to all users of this site whether you are a browser, vendor, merchant, customer, or contributor of content.

FAH Performance may, at any time and without notice, amend these Terms, or may limit or deny access to, or change the content of, the website. You should periodically visit this page to review the current Terms to which you are bound. When leaving this website, please read the website Terms and the privacy policy applicable to the website to ensure you understand and agree with the Terms applicable to that website.

Restricted Use and Copyrights:
All photographs, audio and video clips, picture images, graphics, links, website architecture, format, layout and data structures, and all other items contained on the website are copyrighted unless otherwise noted and may not be used in any manner, except as provided in these Terms or the website text, without FAH Performance prior written permission. Any unauthorized use of these materials may violate copyright, trademark and privacy laws, and other applicable statutes. You may browse this website and download or print a copy of material displayed on the website for your personal use only and not for redistribution, unless consented to in writing by FAH Performance. This limited consent shall automatically terminate upon your breach of any of these website Terms.

Published/Internet Pricing:
FAH Performance  cannot anticipate price increases that manufacturers impose throughout the year, leading to increased pricing. Due to print lead times, all retail prices are subject to change without prior notice. Product specification/appearance, availability, and pricing are all subject to change without notice.

All Orders:
Orders must be processed through the website unless otherwise deemed appropriate by FAH Performance  to offer another means of processing an order. Payments may be made via Bank Transfer or PayID. Orders will not be released without FULL payment. FAH Performance reserve the right to refuse sales/service to ANYONE.

Return Policy:
NO RETURNS OR CANCELLATIONS ON ANY NEW ITEMS / ORDERS REGARDLESS IF THE ITEM HAS SHIPPED OR NOT – DO NOT EVEN ASK – IF YOU ORDERED IT, YOU OWN IT! ALL SALES ARE FINAL. IF YOU HAVE A DAMAGED OR DEFECTIVE ITEM OR WERE SHIPPED THE INCORRECT PRODUCT, IT WILL BE REPLACED OR REPAIRED DEPENDING ON THE ITEM DAMAGE OR PROBLEM. YOU MUST NOTIFY FAH PERFORMANCE OF ANY DAMAGE OR PROBLEM WITHIN 7 DAYS OF DELIVERY. IF YOU HAVE ANY DOUBT ABOUT ANY PRODUCT, DO NOT ORDER IT! PLEASE EMAIL FIRST. THERE ARE ABSOLUTELY NO EXCEPTIONS. IF YOU HAVE SOMETHING YOU NO LONGER NEED, WE SUGGEST SELLING PRIVATELY. SALE PRICES ARE ONLY AVAILABLE DURING THE SALES PERIODS. WE DO NOT HONOR SALE PRICES AFTER THE SALE HAS ENDED. WE DO NOT OFFER REFUNDS OR PRICE ADJUSTMENTS FOR PRODUCTS PURCHASED BEFORE A SALE – DO NOT EVEN ASK!!

Warranty:
All products sold by FAH Performance are covered by the manufacturer’s warranty. FAH Performance is not responsible for products sold that are not covered by a manufacturer’s warranty. Some manufacturers do not offer any form of warranty on their products. For warranty information on specific manufacturers, contact that manufacturer directly.

Products refurbished by FAH Performance are covered by a warranty. Unless otherwise stated FAH Performance does not make any warranty, expressed or implied, or other representation about the use of any of its products. The purchaser expressly ASSUMES THE RISK of all personal, property, and economic injury, damage, or loss, either direct or indirect, arising from the use, misuse, or failure to determine the appropriate use of any product sold here. Warranty is VOID on ANY item that has been disassembled, tampered with. Warranties, where applicable, do not cover neglect, improper installation, misuse, improper tuning, or damage caused by other part failures, failure to comply with this policy releases FAH Performance from ALL warranty obligations.

FAH Performance  is not responsible for any “down time”, storage fees, rental cars, shop fees, or other fees associated with a warranty claim regardless of the cause of failure. The customer is responsible financially for removing the item and shipping it to and from FAH Performance for service or warranty consideration/repair regardless of the cause of failure. FAH Performance staff may discuss your warranty via phone or email including possible causes & whether your suspected problem is covered, this is not a final determination however, the final determination will not be made until the item is returned to FAH Performance  for inspection. Failure to return the item for warranty consideration/inspection releases FAH Performance from ALL warranty obligations. Those products covered by a warranty are ONLY to the original owner/purchaser, this includes products described with a lifetime warranty.

Products that are determined not to be covered by the warranty after inspection by FAH Performance will be returned to the customer at the customer’s expense. Any services rendered to repair a product by FAH Performance or a certified repair facility will incur charges for the repair and shipping. The customer will be responsible for payment of said repair/shipping. All balances on non- warrantied repairs must be paid within 30 days of completion, failure to do so will result in forfeiture of deposit (if made) or forfeiture of the product.

Warranties or Lifetime warranties do not cover misuse or neglect. Warranties or Lifetime warranties do not cover wearable items such as timing chains, brake pads, gaskets, timing wear strips, etc. unless otherwise stated. Any failure by FAH Performance to enforce any of its rights under these Terms & Conditions, or any applicable laws, shall not constitute a waiver of such right.

Shipping:
All shipping will be paid at the customer’s expense unless previously agreed upon with FAH Performance. FAH Performance is not responsible for any shipping delays. Orders placed out of normal hours, will be processed on the next business day. We will do our best to process all orders placed to be shipped by the next business day. 

All lost or damaged products must be reported to FAH Performance within 7 days of receipt according to shipment tracking. Claims made after 7 days will be the sole responsibility of the customer. Upon the arrival of your shipment, please be sure to carefully inspect everything before signing and taking delivery. Any package or product damage must be noted on the delivery receipt if you need to file a claim with the carrier. This means you should remove packing materials to inspect the items for damage that occurred without being visible from the outside with the cardboard and/or plastic wrap still in place. Freight carriers will not take responsibility for damage if you fail to sign the shipment as damaged when received. Every shipment is carefully packaged and inspected before leaving our facility. 

In the unlikely event that your products are damaged, and a claim must be made, please retain any packaging, and DO NOT INSTALL the damaged part. Shipping carriers will want to inspect products and packaging relative to a damage claim. Failure to heed this advisory may result in your claim being denied.
